General Terms and Conditions

NoukStyle is established in Delft and registered with the Chamber of Commerce under number 57515921. The General Terms and Conditions stated below shall apply to all transactions between NoukStyle and its customers. NoukStyle shall not accept any other party's General Terms and Conditions, unless agreed otherwise in writing.

Article 1: General
1.1 These General Terms and Conditions shall apply to all order confirmations, quotations

1.2 Any reference in these general conditions to the "customer" shall be construed as a reference to any private individual or legal entity.

applicable. Deviation from that which is stipulated in these general terms and conditions is only possible if and insofar as this has been explicitly agreed in writing.
1.4 The client accepts the applicability of these general terms and conditions by reserving or booking a

Article 2: Rates
All rates and prices specifically intended for private customers shall include 9% or 21% BTW (Dutch VAT).
2.1 NoukStyle may be hired for a specific service for which the rate applies, or for a specific number of hours. When booking a make-up artist per hour the hourly rate
the hourly rate shall apply. The make-up artist/hairstylist can also be booked for a half or full day, in which case a half or full day fee applies. A half day is based on 4 working hours and a full day on 8 working hours.
2.2 Overtime will be charged at all times. Calculated from 15 minutes after expiry of the end time according to the basic hourly rate. This will be calculated in time units of 15 minutes.
2.3 NoukStyle shall charge 150% of the hourly rate for services performed by the make-up artist/hairstylist between 22:00 and 05:00 hours.
 2.3 NoukStyle shall charge 150% of the hourly rate for services performed by the make-up artist/hairstylist between 22:00 and 05:00 hours.
2.4 NoukStyle shall charge a surcharge of € 75,- for services performed by the make-up artist/hairstylist on Sundays.
2.4 NoukStyle shall charge a surcharge of € 75.
2.5 NoukStyle shall charge a 150% surcharge on the selected package for services performed by the make-up artist/hairstylist on public holidays.
2.6 NoukStyle shall charge a surcharge of € 75,- for services performed by a make-up artist/hairstylist commencing between 06:00 and 07:00.
2.7 NoukStyle shall charge a surcharge of € 75,- for activities of the make-up artist/hairstylist commencing between 05:00 and 06:00.
NoukStyle shall charge a surcharge of € 100,- for work performed by a make-up artist/hairstylist commencing between 05:00 and 06:00 hours.
2.8 A surcharge of € 75,- shall be charged for trial sessions in the evening or at the weekend.
2.9 Waiting money: Should the make-up artist/hairstylist not be able to start her work at the agreed time through the fault of the client, or is there any other reason why the make-up artist cannot carry out her work in the meantime, then waiting money will be charged. The waiting fee amounts to € 35,- per hour.

Article 3: Travel and Expense Allowance
3.1 The travel and other expenses incurred by NoukStyle in connection with its activities shall be paid by the client.
3.1 The travel and other expenses incurred by NoukStyle in connection with its activities shall be for the client's account. Travel expenses shall be based on a kilometre allowance of € 0.45 per kilometre calculated from the correspondence address, being Burgwal 44, Delft.
3.2 Travel costs incurred for work performed abroad shall be borne in full by the client, including any hotel accommodation, food and beverages, unless agreed otherwise in writing by the client and NoukStyle.
3.3 The costs of parking shall be for the customer's account.

Article 4: Conclusion of the Booking
4.1 A booking shall be formed at such time as the customer receives an offer from NoukStyle orally, by telephone, in writing or digitally,
4.1 A booking shall be effective as from the moment the customer accepts NoukStyle's offer orally, by telephone, in writing or digitally.
4.3 The customer acknowledges that it has taken cognisance of and agrees to NoukStyle's General Conditions before making a booking.
4.4 The first quotation issued shall be free of obligation for both parties; no rights may be derived from printing errors, typing errors and mutilated quotations.
4.5 An offer is valid for one (in words: one) month, unless explicitly stated otherwise.
4.6 Offers and quotations do not apply automatically to future orders.

Article 5: Payment
5.1 Upon completion of the order confirmation/contract, the client shall pay the invoiced amount in full within 14 days of the invoice date.
5.2 After acceptance, reservation costs will be charged.
5.3 Booking costs are understood to be 20% of the accepted quoted amount, excluding travel expenses.
5.4 Costs for the try-out session, being € 225,00, have to be paid two weeks before the try-out takes place.
5.5 Costs for the wedding day itself have to be paid two weeks before the try-out session.
5.6 Complaints concerning the invoice:
The client must give reasons for his/her objection to the sent invoice in writing within 8 days. After this period, he is deemed to agree with the content of the invoice.
5.7 Exceeding the stated term of payment:
5.7.1 If the customer fails to pay an invoice within the payment term, NoukStyle may, after notifying the customer, suspend all its work on the order until the invoice amount has been paid.
5.7.2 If the said term of payment is exceeded the customer shall be in default by operation of law and shall owe statutory interest on the entire amount invoiced, commencing on the due date (being two weeks after the invoice is payable) and ending on the date of payment to NoukStyle.
5.8 Costs of collection:
All costs of collection incurred by the customer in the event of failure to pay, whether out of court or in court, shall be for the customer's account.

Article 6: Cancellation, Termination and Suspension of the Agreement
6.1 Cancellation, termination or suspension of the agreement or its dissolution shall take place in writing.
6.2 If the customer cancels an agreement in whole or in part, the costs incurred by NoukStyle as a result of that cancellation, including costs incurred by third parties, shall be reimbursed in full by the customer.
6.3 Reservation costs shall at all times not be refunded to the customer.
6.4 In case of cancellation of the agreement by the customer from:

6.4.1 90 to 31 days before the date of the performance NoukStyle shall charge 50% of the quoted amount; 6.4.2 to 6.4.3 the costs of the cancellation shall be borne by the customer.
         NoukStyle shall charge 50% of the amount quoted;
6.4.2 30 to 8 days before the performance date NoukStyle shall charge 75% of the quoted amount;
6.4.3 7 days to the date of execution NoukStyle shall charge 100% of the quoted amount;
6.5 If the order is cancelled after the try-out session/try-out has taken place, the customer shall pay the costs of a try-out session/try-out on the basis of the then applicable prices for a try-out mentioned on NoukStyle's website, www.NoukStyle.nl.
If a booked assignment is cancelled, the client shall owe the following cancellation costs:
6.5.1 30 to 8 days before the performance date NoukStyle shall charge 75% of the quoted amount;
6.5.2 7 days to the date of performance NoukStyle shall charge 100% of the quoted amount;


Article 7: Force Majeure
7.1 In the event of force majeure on NoukStyle's part, including sickness, NoukStyle may at any time cancel all or part of the order. Invoicing shall then be adjusted accordingly. NoukStyle shall have several colleagues available to take over the assignment for bridal hairdressing and bridal make-up. However, no guarantee of availability can be given.
7.2 If NoukStyle is unable to perform its delivery obligation or to perform it properly or in good time due to force majeure, it shall be entitled, at its option, to regard the agreement or the part not yet performed as dissolved or to suspend the agreement for a certain or indefinite period of time. In the event of force majeure the other party shall not be able to claim damages from NoukStyle or claim the costs charged.
7.3 Force majeure shall include: war, riots and hostilities of any nature whatsoever, blockade, boycott, natural disasters, epidemics, pandemics, lack of raw materials, prevention and interruption of transport possibilities, breakdowns in our business, import and export restrictions or bans, impediments caused by measures, laws or decisions of international, national and regional (government) bodies.


Article 8: Liability
8.1 NoukStyle excludes any liability and rejects any claims for damages, whether direct or indirect, ensuing from circumstances that cannot be attributed to NoukStyle and that cannot reasonably be attributed to NoukStyle under the law or according to generally accepted standards.
8.2 Only damage for which NoukStyle is insured and which is compensated by the insurer shall qualify for compensation. Consequential damage and immaterial damage shall not qualify.
8.3 Although NoukStyle uses dermatologically tested cosmetics and hygiene has a high priority, an allergic reaction may occur due to the use of cosmetics. NoukStyle shall not be liable for allergic reactions or inflammations caused by the use of brushes, make-up products or other materials.

Article 9: Privacy
9.1 NoukStyle is transparent and handles personal data with care. We shall make every effort to ensure the reliability, security and integrity of the data collected by us.

Article 10: Amendment, explanation and location of these conditions
10.1 These conditions can be found on NoukStyle's website: www.NoukStyle.nl.
10.2 The Dutch text of these general conditions shall always prevail in respect of any interpretation of their contents and purport.
10.3 The most recently filed version shall always apply.
10.4 These general conditions and any agreement between the customer and NoukStyle shall be governed by Dutch law.

Special and/or sensitive personal details that we process
Our website and/or service has no intention of collecting data about website visitors who are younger than 16 years of age. Unless they have permission from their parents or guardian. However, we cannot verify whether a visitor is over 16. We therefore recommend that parents be involved in the online activities of their children, in order to prevent data being collected on children without parental permission. If you are convinced that we have collected personal data on a minor without such consent, please contact us at info@noukstyle.nl and we will delete this information.

For what purposes and on what basis do we process personal data?
NoukStyle processes your personal data for the following purposes:
- To process your payment
- To be able to call you or send you an e-mail if this is necessary for us to perform our services
- To deliver goods and services to you


Automated decision making
NoukStyle does not make any decisions about matters that could have a significant impact on others, based on automated processes. These decisions are made by computer programs or systems, without the intervention of a human being (for example an employee of NoukStyle).

How long we keep personal data
NoukStyle shall retain your personal data for no longer than is strictly necessary to fulfill the purposes for which the data is collected. We use the following retention periods for the following (categories of) personal data:

- NoukStyle only provides personal information to third parties if necessary for the execution of our agreement with you or to comply with legal obligations.
- Your data will be securely stored in a non-publicly accessible database.
- We only publish photos of clients after receiving express permission.

Cookies, or similar techniques, that we use
NoukStyle only uses technical and functional cookies. And analytical cookies that do not infringe on your privacy. A cookie is a small text file that is stored on your computer, tablet or smartphone when you first visit this website. The cookies we use are necessary for the technical functioning of the website and your ease of use. They ensure that the website works properly and remember, for example, your preferences. They also enable us to optimise our website. You can unsubscribe from cookies by configuring your internet browser in such a way that it no longer saves any cookies. In addition, you can delete all information previously stored using your browser settings.

Reviewing, modifying or deleting data
You have the right to view, correct or delete your personal data. You are also entitled to withdraw your consent for data processing or to object to the processing of your personal data by NoukStyle and you have the right to data portability. This means that you may request us to send the personal data we hold on you in a computer file to you or another organisation designated by you.

You can send a request for inspection, correction, deletion, data modification or request to withdraw your permission or objection to the processing of your personal data to info@noukstyle.nl.

To make sure that the request for inspection was made by you, we ask you to send a copy of your identity document with the request. Please make sure that your passport photo, MRZ (machine readable zone), passport number and Citizen Service Number (BSN) are blackened in this copy. This is to protect your privacy. We will respond to your request as quickly as possible, but within four weeks.
